Residential Terms and Conditions

These Terms and Conditions govern the ClimateWorks Care Plan provided by ClimateWorksUK Ltd. By joining the Care Plan, the Customer agrees to the terms set out below.

The Care Plan is available to customers located within England.

2. Definitions

Indoor Unit — An indoor air conditioning unit installed inside a property.

Outdoor Unit — An external condenser connected to indoor units.

Room — For pricing purposes, a room refers to each indoor air conditioning unit serving a space.

Ventilation System — A Mechanical Ventilation with Heat Recovery unit.

System — For MVHR, a system refers to each individual MVHR unit.

Eligible Equipment

Wall mounted, floor mounted, cassette and ducted air conditioning systems. MVHR ventilation systems.

Excluded Equipment

Portable or plug in units. Window mounted systems.

3. Residential Eligibility

The Care Plan applies to residential properties only.

Air conditioning plans cover up to 5 rooms unless otherwise agreed.

MVHR plans cover up to 2 systems unless otherwise agreed.

Systems must:

• be under 10 years old

• be fully operational

• be safely accessible

ClimateWorks may require inspection prior to acceptance.

4. Pricing

Pricing is based on:

• number of rooms for air conditioning

• number of systems for MVHR

Pricing assumes one outdoor unit per air conditioning system.

Additional outdoor units may require adjusted pricing.

Payments are collected monthly via Direct Debit.

All pricing includes VAT.

5. Contract Term

The Care Plan is a minimum 12 month subscription.

The agreement automatically renews for further 12 month periods unless cancelled.

Customers may cancel at any time.

No refunds are provided.

All remaining payments within the active 12 month term remain payable.

6. Payment Terms

Payments are collected monthly via Direct Debit.

Failed payments:

First failure — Customer notified

Second failure — Benefits may be suspended

Third failure — Plan may be terminated

ClimateWorks reserves the right to recover outstanding amounts.

7. Cooling Off Period

A 14 day cooling off period applies to remote purchases.

If services are requested within this period and then cancelled, charges may apply.

8. Service Entitlement

The Care Plan includes one planned preventative maintenance visit per 12 month period.

The service becomes due after 12 months from the start date.

Services do not carry forward.

9. Waiting Period and Service Timing

A 30 day waiting period applies from the start date.

The Care Plan does not include an immediate service.

If a system is due for service within the first 30 days, this will be charged at the standard rate.

Customers joining close to a service due date must pay for that service separately.

All other Care Plan benefits become active after the 30 day waiting period.

10. Scope of Air Conditioning Service

Includes:

• Cleaning internal unit fascia and filters

• Cleaning condensate systems

• Inspecting coils

• Cleaning outdoor units

• Leak checks

• Electrical checks

• Performance testing

Filters are cleaned only. Replacement is chargeable.

Refrigerant is not included.

11. Scope of MVHR Service

Includes:

• Filter cleaning

• Airflow testing

• Fan and motor inspection

• Heat exchanger inspection

• System cleaning

Filters are replaced only if included in the selected plan.

Additional filters are chargeable.

12. Breakdown Attendance

Includes:

• Up to 1 breakdown visit per 12 months

• No callout charge

• First hour of labour included

Additional labour is charged at £75 per hour.

All parts and materials are chargeable.

10 percent labour discount applies.

Visits are limited to Monday to Friday, 08:00 to 17:00.

13. Customer Responsibilities

Customers must:

• provide safe access

• maintain basic cleanliness

• keep systems unobstructed

• report faults promptly

Failure to do so may affect coverage.

14. Exclusions

The Care Plan does not cover:

• pre existing faults

• electrical supply issues

• misuse or neglect

• third party work

• structural issues

• vermin, weather or damage

• refrigerant leaks or recharge

15. Access Requirements

Customers must provide:

• clear access

• safe working conditions

• parking

Parking charges may be passed on.

Unsafe conditions may result in refusal of work.

16. Misuse and Non Fault Visits

Non fault visits may be charged.

Examples include:

• incorrect settings

• power issues

• user error

Repeated misuse may result in termination.

17. Uneconomical Equipment

Where systems are no longer viable to repair, ClimateWorks may recommend replacement or remove them from the plan.

18. Refrigerant and Repairs

Refrigerant and leak repairs are not included.

Leaks must be repaired before recharge.

19. Pre Existing Faults

Faults present before joining are not covered.

Systems must be repaired before acceptance.

20. Property Sale or Equipment Change

The plan ends upon sale unless transferred.

Replacement systems may be added subject to inspection.

21. Subcontractors

ClimateWorks may appoint subcontractors to carry out services.

22. Force Majeure

ClimateWorks is not liable for delays outside its control.

23. Liability

Liability is limited to fees paid in the previous 12 months.

No liability for indirect losses.

24. Governing Law

This agreement is governed by the laws of England and Wales.

PLAIN ENGLISH SUMMARY

• Your plan runs for a minimum of 12 months

• You pay monthly instead of one large yearly cost

• Your service is included after 12 months

• If your service is due soon, you still pay for it separately

• All other benefits start after 30 days

• You get breakdown support, priority booking and discounts

• You can cancel anytime, but payments for the full term remain payable
